Which subjects, when participating in voluntary social insurance, are supported by the State in payment and support level?
According to the provisions of Clause 1, Article 14 of Decree No. 134/2015/ND-CP dated December 29, 2015, detailing a number of articles of the law on social insurance on voluntary social insurance, voluntary social insurance participants are supported by the State at a percentage (%) above the monthly social insurance premium according to the poverty line of rural areas, specifically:
- 30% for voluntary social insurance participants belonging to poor households;
- 25% for participants voluntary social insurance belonging to near-poor households;
- Equal to 10% for other subjects.
According to the provisions of Clause 3, Article 43 of the Employment Law, individuals who hire and use labor under a labor contract with a term of 03 months or more must participate in unemployment insurance.
According to the provisions of Clause 1 and Clause 6, Article 16 of Decree No. 115/2015/ND-CP, the cases of suspension of payment to the pension fund and death are as follows:
- Suspension of production and business for 1 month or more due to difficulties when changing structure, technology or due to crisis, economic recession or implementation of State policies when restructuring the economy or implementing international commitments;
- Difficulties due to natural disasters, fires, epidemics, crop failure
According to the provisions at Point e, Clause 1, Article 7 of Decree No. 146/2018/ND-CP dated October 17, 2018, detailing and guiding measures to implement a number of articles of the Law on Health Insurance, the payment is 4.5% of the base salary. According to the provisions of Point c, Clause 1, Article 8 of Decree No. 146/2018/ND-CP dated October 17, 2018, the level of support from the state budget is at least 30% of the health insurance premium. In case a person belonging to many subjects supported by the state budget, the level of payment is entitled to the level of health insurance premium support according to the subjects with the highest level of support.
How long does it take for the Ministry of Finance to approve life insurance products?
Within 21 working days from the date of receipt of all valid documents, the Ministry of Finance has a written approval. Based on the provisions of Clause 1, Article 26 of the Labor Code No. 10/2012/QH13, probationary contracts do not have to pay compulsory social insurance.
